Re: Jonathan J. Pollard

Dear Ambassador Walker,

Thank you for taking the time from your busy schedule to meet with me concerning my client. Jonathan J. Pollard, who is currently incarcerated at the F.C.I. in Butner, North Carolina.

In an effort to make our position as clear as possible I thought it best to memorialize in writing those issues that I wish to raise at our meeting and hereby request that you convey to the American government the following requests:

  1. We are requesting copies of all documents submitted by any of the government agencies involved with the review process currently undertaken by President Clinton concerning Mr. Pollard's request for pardon.

  2. We are requesting complete access to Mr. Pollard's entire file, including the full damage assessment report prepared by the government. If portions of the file have to be declassified to comply with this request then we hereby request that the government declassify them.

  3. We are requesting that all defense agencies agree to comply with and respond to the Freedom of Information (FOI) requests which were submitted more than twelve months ago, which to date have not been answered.

  4. We are requesting written confirmation by the Department of Justice that Jonathan J. Pollard was never accused, charged, indicted, or convicted of treason.

  5. We are requesting written confirmation from the government that Jonathan J. Pollard did not possess nor did he have the necessary security clearances needed to gain access to cryptological information.

  6. We are requesting written confirmation from the Justice Department that no evidence was ever produced in court that proved that Jonathan J. Pollard ever compromised any codes and/or cryptological data.

  7. We are requesting written confirmation from the government that Jonathan J. Pollard was never accused, charged, indicted, or convicted of causing the deaths of any United States agents anywhere in the world.

  8. We are requesting written confirmation from the Justice Department that the last-minute classified affidavit and memorandum submitted to the court by then-secretary of defense, Caspar Weinberger prior to sentencing of my client, was done at the personal initiative of Mr. Weinberger and not done because of a request by the Justice Department or by the court.

  9. We are requesting written confirmation as to when the review process concerning Mr. Pollard's pardon request will be completed and when we can expect a decision by the President.

Many of these issues were previously raised by me in several letters to White House Counsel Charles Ruff but unfortunately no reply was ever received. I would therefore appreciate your written response to these requests within 10 days from the date hereof.
